A. VOLUNTARY DISMISSAL – NOTICE REQUIREMENT:
Any party or party’s counsel who has filed a notice of dismissal or a stipulation of dismissal
pursuant to Civ. R. 41(A)(1) shall promptly inform the assigned Judge of the voluntary
dismissal.

B. INVOLUNTARY DISMISSAL – DISMISSAL FOR WANT OF PROSECUTION:
In accordance with Civ. R. 41(B)(1), the Court, upon its own motion or upon the motion of a
defendant, may dismiss an action or a claim if notice is given to the plaintiff or plaintiff’s
counsel and any of the following conditions are met:
1. The plaintiff fails to prosecute;
2. The plaintiff fails to comply with these Rules;
3. The plaintiff fails to comply with any Court order; or
4. The case has been pending an unreasonable length of time without any required action
